Q I had a sandwich delivered to my office, but the one I ate turned out to be from my coworker’s order rather than mine. May I say Birkas Hamazon?

A The Shulchan Aruch (O.C. 196:1) rules that one does not recite a bracha on forbidden food, neither before nor after. But if the prohibition was violated beshogeig, poskim disagree. The Mishnah Brurah (ibid. 4) rules like the Taz that one should bentsch. Because others dispute this, it is preferable to eliminate the safeik by eating an additional kezayis of bread (Piskei Teshuvos ibid. 1). If at the time of the original bracha rishonah you intended to eat that bread as well, a new bracha rishonah is not required, because mei’ikar hadin the Hamotzi on the forbidden food was valid.
There is a discussion among the poskim whether paying back the victim in such a case rectifies the matter retroactively (see Sha’arei Teshuvah 658:4 about someone who stole an esrog on Yom Tov, used it for the mitzvah, and then appeased the victim on Chol Hamo’ed). So it is advisable that you compensate or appease him before bentsching, as that may eliminate the safeik bracha entirely.
Even according to the Taz, who requires Birkas Hamazon for a shogeig, you cannot be counted for a zimun, because illicit eating, even unintentional, inherently lacks kvius. This should apply even after compensation, because an act of gezel does not constitute kvias seudah even if there was subsequent compensation (see Piskei Teshuvos 196 fn. 28).
The Magein Avraham (psichah to siman 196) suggests that the problem of bracha and zimun on forbidden food doesn’t apply to stolen food: The thief acquires it via shinuy (transformation) when he chews it, so by the time he swallows it, it’s already his. Although the Mishnah Brurah (Sha’ar Hatziyun ibid. 9) rejects this, it can be adduced as an additional factor to permit zimun if there is a collegial atmosphere in your office, as there’s a strong case to be made that in such an environment there was no theft, because the victim is not makpid if a mistake happens.
