Indented. Indebted?

“It’s fine, don’t worry about it” is what my wife told the neighbor who dented our car. But I’d like to be reimbursed. Is the debt already forgiven?

A Whether the damage has been forgiven depends on who owns and has halachic rights to the car. Ownership is determined not by the name on the title but by who paid for the vehicle (see Pis’chei Choshen Hil. Ishus 8 fn. 174).

If your wife bought the car while yet single, she is the owner. But a husband has usage rights to nichsei melug (assets his wife brought into the marriage), and those rights generally prevent her from forgiving damage to the asset (Even Ha’ezer 91:1) unless he forwent his rights (see E.H. 92:1).

If the car was purchased with money that either spouse earned during the marriage, ownership generally rests entirely with the husband, because Chazal instituted that a woman’s ma’asei yadayim (income) belongs to her husband in exchange for him supporting her financially (Ksubos 58b).

If the wife is the primary breadwinner and her husband relies on her income, some poskim say she retains ownership of her earnings (Maharit 2:67; see discussion in Pis’chei Choshen ibid. 10 fn. 21). In that case, she owns the car, so her waiver is effective.

Civil law often treats marital assets as jointly owned and divides them equally in the case of divorce. In such jurisdictions, batei din often follow that model in settlements. That might seem to suggest that the wife is a 50% partner and should be able to forgo half the damage, but it is only done for settlement purposes and does not indicate ownership during marriage.

Finally, even if your wife had the right to waive payment, saying “It’s fine, don’t worry about it” doesn’t constitute a waiver of a claim, as such language is typically understood as polite reassurance rather than actual forgiveness of a financial obligation. Without clear language like “I forgive the debt,” you remain entitled to compensation (R’ Naftali Nussbaum, Hayashar Vehatov Vol. 11 p. 68).
